Berks County Republican Committee appeals the Court of Common Pleas Order Denying a Vote Re-count to the PA Commonwealth Court.

The Berks County Republican Committee filed a timely appeal with the Pennsylvania Commonwealth Court, which seeks to overturn a Court of Common Pleas order that denied the Berks County Republican Committee’s request for a manual re-count of all ballots cast in 30 precincts within Berks County. In our brief filed on January 6, 2023, we argued that PA Election Code section 3261(a) allows for a manual re-count of all ballots cast, including mail-in, absentee and provisional ballots.

Why?
The Berks County Republican Committee seeks to ensure compliance with Election laws and the prevention of fraudulent and unfair elections. Furthermore the Berks County Republican Committee seeks to protect Republican voters’ fundamental rights to free, fair and accurate elections.

Our petition was filed in response to many election day voting problems and complaints. The Berks County Republican Committee believes that it is vital to have election integrity in Berks County and throughout Pennsylvania.

During the November 8, 2022 Election, the Berks County Republican Committee received many complaints of voting problems with the Berks County Election Board voting systems. In a sworn affidavit, a Berks County Election worker detailed that the Election Systems & Software (ES&S) equipment failed to record the votes cast by three voters in her precinct.

Surprisingly, in 2022, the Berks County Election Board publicly stated that they will not conduct any
signature verification of mail-in ballots.

The United States Constitution, through the 15th Amendment adopted over 150 years ago, states “The right of Citizens of the United States to vote shall not be denied or abridged by the United States or any State.” Furthermore, the Pennsylvania Constitution guarantees citizens the right to vote and for the “free,
fair and correct computation and canvass of the votes cast.”
